"How big of a risk would it be to file on EB2? If they reject me for EB2, would it hurt my chances on applying again on EB3? How much time would I lose in case of a rejection?"

Your PD being what it is ..I dont think it really matters in terms of time whether its EB2 or EB3. Honestly I think the best bet is to have an approved 140 ASAP.

Your date becoming current anytime without congressional action is very rare. But Lets assume there is a congressional action and you have a problem with your 140 .. your petition cannot be approved even though your date becomes current. Another important thing to consider is A2P at 140 stage, it depends on your company's size , profitability ...

One can present a contradictory argument much more eloquently too.

You have to keep in my mind that "there is no premium processing available for 140 now".

Convetional wisdom of my attorney is that dont attract unnecessary scrutiny, so far he has been proven right in my case ....

Good luck with your journey .. you have a pretty long road ahead of ya

If she is on H4, as long as H1 is valid she can continue legally in US. I do not see any reason for her to go back.
She can file I-485 as a dependent, since she is still the wife of the I-485 primary applicant.

Just ask her to recapture 350,000 previous year's visas- That's all! Nothing else will fly in this economy in any immigration bill, EXCEPT for Visa Recapture!

    Hello All,

Out of curiosity, I called the congresswoman's office to ask if she would be re-sponsoring the visa recapture bill. The person on the phone asked me to call back next week, because at present she was considering about it.

Can we all try to call her office and request her to re sponsor this bill, as this will help the housing crisis.

I am posting a link, you all can call her office and even explain to the person about why this bill is so important. ( wait to be transferred to the specific person who handles immigration issues, don't talk to the phone operator as she would care less)

Good Luck to all of us.

By Eleanor Pelta, AILA First Vice President

The latest salvo in the war against H-1B workers and their employers (and this time, theyve thrown L-1s in just for fun,) is the Economic Policy Institutes briefing paper by Ron Hira, released last week, which concludes that the practice of using H-1B and L-1 workers and then sending them back to their home countries is bad for the economy. While Hiras findings are certainly headline-grabbing, the road that Hira takes to get there is filled with twists, turns and manipulations and simply lacks real data.

Hira starts with the premise that some employers use H-1Bs and L visas as a bridge to permanent residence, and some employers use those categories for temporary worker mobility. (His particular political bent is belied by his constant usage of the term guest-worker statusa term that brings with it the politically charged connotations of the European guest worker programs for unskilled workersfor the practice of bringing H-1Bs and Ls in to the U.S. on a temporary basis.) After examining his data, he divides the world of employers into two broad categories:

Bad guys (generally foreign employers, no surprise, or U.S. employers with off-shore companies in India) that bring in H-1B and L workers for temporary periods, exploit them, underpay them and send them home after they get training from the American workers whose jobs they will outsource when they return home
Good guys (U.S. corporations Hira uses the more genteel label, firms with traditional business models) that bring H-1B and L workers to the U.S., pay them adequate wages, and sponsor them for permanent residence, thereby effecting a knowledge transfer to American colleagues that is good for the economy

Hiras tool, a statistic he calls immigration yield, is simply a comparison of H-1B and L usage and the number of PERM applications filed by the highest users of those visas. He essentially concludes that because the highest users of H-1Bs and Ls are Indian consulting companies, and these companies have only a minimal number of PERMs certified, they are using Hs and Ls as cheap temporary labor. He is unable to explain away the high number PERM filings of one of the IT consulting companies, and so he addresses this anomaly by saying part of the explanation might be that it is headquartered in the United States.

There are too many things wrong with this analysis to list in this blog, but here are a just a few ways in which Hiras study is problematic:

Hiras clear implication is that companies that dont sponsor H-1Bs and Ls for PERM are using these workers instead of more expensive American labor. He ignores that fact the H-1B program has rules in place requiring payment of the prevailing wage to these workers. But even worse, he has not presented any data whatsoever on the average wages paid to these workers. He also doesnt address the expense of obtaining such visas. He simply concludes that because they are here temporarily, they are underpaid.

Hira makes the argument that companies who use H-1B and L workers as temporary workers generally use their U.S. operations as a training ground for these workers and then send then back to their home countries to do the job that was once located here. Again, this assertion is not supported by any real statistical data about, or serious review of, the U.S. activities of such workers, but rather by anecdotal evidence and quotes from news stories taken out of context.

With respect to the fact that the L-1B visa requires specialized knowledge and so would normally preclude entry to the U.S. for the purpose of gaining training, Hira cites and outdated OIG report that alleges that adjudicators will approve any L-1B petition, because the standards are so broad. Those of use in the field struggling with the 10 page RFEs typically issued automatically on any specialized knowledge petition would certainly beg to differ with that point.

Hira clearly implies that American jobs are lost because of H-1B and L guest workers, but has no direct statistical evidence of such job loss.

The fact is that usage of H-1B and L visas varies with the needs of the employer. Some employers use these programs to rotate experienced, professional workers into the United States and then send the workers abroad to continue their careers. Some employers bring H-1Bs and Ls into the U.S. to rely on their skills on a permanent basis. Judging from the fraud statistics as well as DOL enforcement actions, the majority of employers who use H-1B workers pay these workers adequate wages and comply with all of the DOL rules regarding use of these workers, whether the employers bring them in for temporary purposes or not. By the same token, the minority of employers who seek to abuse H and L workers may well do so, whether they intend to sponsor them for permanent residence or not. Indeed, arguably, the potential for long-term abuse is much worse in the situation in which a real bad guy employer is sponsoring an employee for a green card, because of the inordinate length of time it takes for many H-1B and L workers to obtain permanent residency due to backlogs.

Hira does make that last point, and it is just about the only one we agree on. Congress needs to create a streamlined way for employers to access and retain in the U.S. foreign expertise and talent, without at 10-15 year wait for permanent residence. But our economy still needs the ability for business to nimbly move talent to the U.S. on a temporary basis when needed, or to rotate key personnel internationally. In a world where global mobility means increased competitiveness, Hiras statistics simply dont support elimination of these crucial capability.https://blogger.googleusercontent.com/tracker/186823568153827945-6000198492670312275?l=ailaleadership.blogspot.com

Is it necessary to file second time with I-140 reciept?
    What is the fee?
Do you have new form I-485 and I-765 (EAD)?

I heard one did not need apply another I-765 (EAD) unless it is expired or voided (one 140 approved is enough :D )

now 485 fee is $1010 for an adult, already including I-765 (EAD) fee

    Hi kzinjuwadia,

Thank you for your reply, made me relaxed, hopefully, things will go smooth and without any RFE on my side, already had so many problems with my wife's case and hopefully, we will get her GC very soon thru the court (She was out of status on H4 and I-485 denied and she was put in deportation proceedings and we got retroactive H4 NPT Approval and filed the I-485 in the court and hopefully will get her GC soon since my PD is current).

    Thanks Again.

I don't think infopass does any harm to you. it may give more info ahead of time. I had infopass on may 12 as one of my friends with later PD got the approval email. the IO told me the case is approved and approvals are mailed already. got the GC next day :) This is my experience. I don't know if anyone had a bad experience at infopass or something that caused additional problem for their case. I think your's is a genuine case as your PD is current and it's almost month end and many with PD after you are already approved.

I apologize from the beginning if Im asking some stupid questions but Im really confused after I read all those I-140 issues posted on this forum.
I just received today my LC after a long wait in backlog from 04/2001.
    1. My lawyer is asking me for $1000.00 premium processing fee and some documents from my employer for this PP for I-140. Is it still available?
    2. How long will be until this I-140 gets approved? Anyone who did this lately?
    3. Im filling I-140 together with I-485. It matters, time PP wise?
    4. Is there anothernext step towards the GC or just wait for those to be approved?
    5. Im so squeezed on my wallet, how much money will be still needed until the GC is in my hand?
I paid so far more then 35G. - The previous steps in processing fees and lawyers fees.

I would really appreciate some honest answers; Im seriously thinking to go back to my country if the GC will be too far away.

Thank you guys for your attention and thanks IV for the good work done so far.
    :)

My intent is not to divide IV. I was just highlighting EB non-ROW.

Forgive my ignorance. Is there any specific Issues that hamper EB-ROW ?

    Please enlighten me.

Why would you divide employment based immigration in to ROW vs non-ROW? Do you think folks from ROW don't deserve any relief? This is the kind of mentality which divides this small community of EB immigrants. This community is extremely small as it is in grand scheme of things so please don't try to divide it any further and make this community so small that it becomes irrelevant. Just a piece of advise.

From our meet & greet last saturday:

    GC Quiz:
Created For: Dallas Greet-Eat meet: 10/06/07 -- Immigration Voice
    -----------------------------------------------------------------------------------------------------------------------------------------

What are the Pros and Cons of AOS and Consular Processing?
Explain the terms: Priority Date, I-140, 485, PERM, EB1, EB2, EB3, Country based quotas, Visa revalidation, EAD, Advanced Parole, Biometrics, Finger Printing.
You have not got your green card yet. What do you think what is preventing the system to give you the green card?
What is the importance of Employment Letter in AOS or consular filing stage?
    What is AC21 law?
If CIR bill would have been passed and became the law what benefits (being an EB based applicant) you might have gained?
You are holding Masters Degree and had 8 years of experience before coming to USA and work for your first US based company then also your Green Card application was filed under EB3 category. Why?
What are RIR and regular processing for old Labor approval system?
Why Labor and are considered employers property and 485 Employees property?
What is the purpose of Labor approval process as a sub stage in Green Card Process?
    Define the term Permanent Resident.
What would be your obligations as Permanent resident?
What is Visa Bulletin? And which agencies are involved in creating and publishing visa bulletin?
Explain different codes for Finger Printing process
You applied for your EB based 485 along with EAD and AP during July Fiasco. You have just received your EAD approval and Finger printing is also done. Your H1B Visa stamp in passport is expired. Your friend in Canada invites you to visit him for 29 days for a big celebration. Can you visit Canada? If no than explain us why and if yes than explain us which kind of immigration related documents you MUST keep with you while visiting.
Same question as above but for 31 days or longer visit.
What is the easiest way as a citizen of India for you to become permanent resident of USA? Choose only one. And explain your answer.
    -Apply under family category
    -Apply under employment based category
-Apply as Investor/entrepreneur (Start a business)
    -Marry to a US citizen

What is the best option: To work on H1B OR to work on EAD? And why?
You applied for 485 in February 2007. You have received your approvals for EAD and AP by now but still you have chosen to work with your present employer on H1B Visa. You are getting a very good job offer which you do not want to loose. What strategy you would consider a best strategy so you get this new lucrative job and do not jeopardize your green card process.
What historical part Immigration voice has played so far for streamlining EB based immigration?
Which factors can jeopardize your Green Card in case of very long processing wait?
You are a citizen of India. You came in USA on H1B visa in year 2000. Your employer filed your Green Card under EB3 NON RIR category. Down the road your company filed the Green Card for your Pakistani colleague in year 2005 and in year 2006 November you came to know that your Pakistani colleague became permanent resident as his GC application approved. Upon hearing this news you get frustrated. What do you think why your Green card is not yet approved? What could be the reasons behind this long delay?
What is the Maximum limit of Visa numbers applicable to Indian citizens under all EB categories?
What is LIFE act? To which kind of Green Card applicants it can affect?
Once you get Green Card. What will you do to retain it forever?
    What is Re-entry Permit?
How long you can remain as permanent resident of USA?
