Hi Friends,
I'm working with employer A and my PERM labor got certified with employer B. My second H1B duration ends Sep 2011 (12 months) and I can recapture 5 months.
1. Will I get 3 yrs of H1B extension if do the H1B transfer after my I-140 with employer B is approved.
2. Will I get 2 years of H1B extension (09/2011 + 1 yr with approved Labor) if I do H1B transfer now?
3. I went for a vacation and returned US just now. My employer A has generated pay stub only for a week and forgot to pay for the vacation. Is it Ok to submit partially paid last pay stub for the H1B transfer. FYI, I've all the other pay stubs for the previous months.
It'll really helpful to decide based on the folks replies. Thanks alot for the help.

Hi,
I'm in the process of going through the naturalization process having filed the N-400 form.
However, I have a change of plans and would like to 'abandon' my naturalization application.
Would this affect any of my future applications? be it a future naturalization application or petition for a relative the green card.
Thanks for any advice as I can't seem to get a definite answer.

My passport expires in Jan 2010.
Is there a time frame by which I need to renew passport? Can I go sometime this month or should it be within 6 months of expiration?

Do I need to fill G-28 Form along with I-140, I-485.
We didn't fill any form like that. Is it o.k.??
She (Attorney) is representing for Company,not representing for Client and Company, but She signed on I-140 and I-485.

I would like to apply for the H1B Visa. For the same, I would like to clarify whether I am eligible with the following education background (Basically I am looking for the 16Yrs education criteria)
1) Did schooling up to 10th (10 Yrs)
2) Did Diploma (3 Yrs, Full Time)
3) Total IT work experience is 9.10 Yrs
4) Did B.S ( Bachelor of Science -- 3Yrs - Work Integrated Course/Distance Edu)
5) Did M.S (Master of Science -- 2Yrs - Work Integrated Course/Distance Edu)

This question is for those who are residing in TX and renewed their AP. Recently I applied (efiling) for AP renewal for my spouse, the online system directed me to mail the supporting documents to Nebraska. I am thinking this is because our 485 is pending in Lincoln, NE. Did anyone who renewed their parole sent the supporting documents to TX. I have a wierd feeling that TX service center is much faster in EAD and AP renewals compared to NE. Can someone advice. Also, if doing a paper filing, can I send it to TX service center since I reside in TX? Thanks in advance.

Hello All,
I have two questions about using EAD and H1B status.
Background:
My GC is in EB3 category. I got my EAD in 2007 and renewing it every year on time. My H1B is also valid with my current employer. I have used advance parole while coming back from India. I don't know if that makes any difference.
Last year I have done some part time (after hours and weekend) work for different employer and got 1099 tax forms.
Q1) Does it mean my H1B is invalid or can I still continue to be in H1B immigration status?
Q2) If I find a new employer who is willing to file labor under EB2 then can I continue the H1B status with the new employer? If not can I work for the new employer using EAD and still start my green card process?
Please advice.

Now they are saying that they might not be able to apply for my PR before the start of my 6th year of H-1 and are offering me the following option: Need to leave US and go back to India or any other country, will be paid US salary and then after one year will be brought back on a L-1A visa. Now my question is can they pay in US dollars while i am outside US and still be able to come back on L-1A visa? or do i need to change into local payroll?

1. I'm AOS aplicant currently working with company X in US and planning to go to abroad and work for other employer Y for 1 year in abroad. Once I come back to US ,can i join with employer X on H1B and continue with GC processing?
If above can't be done
2. Assuming I withdraw my 485,so i will on H1B status. If H1B applicant currently working with company X in US and work for other employer Y for 1 year in abroad. Once I come back to US ,can i join with employer X on H1B and later continue with GC processing? - or H1B status abandon as soon as i change employment in Abroad

I came to US on J1 visa (exchange visitor program) and got waiver and converted to H1 visa. I could not apply for I-140 due to employers problems and now I have short of time for H1 extension.
Can I convert my visa to J1 again? Is H1 to J1 visa possible? Please advise.
